Mercer County Expungement After Release
Release does not itself erase an arrest, case, booking entry, or photograph. For an eligible West Virginia conviction, section 61-11-26 measures the waiting period from the latest of conviction, completion of incarceration, or completion of supervision. A person who leaves jail but remains on parole or probation may not have reached the starting point. The statute uses one year for one eligible misdemeanor, two years for multiple eligible misdemeanors, and five years for an eligible nonviolent felony, with many excluded offenses.
The petition goes to the circuit court of conviction. A granted order seals the court record and directs other covered agencies to expunge their records. Agencies generally certify compliance within sixty days. The statute also includes the civil filing fee and a one-hundred-dollar State Police processing fee. Research did not verify that the public prison portal preserves former inmates or shows a released-status archive. Do not invent such a result. Mercer County Release Status Elsewhere
Parole and probation belong to different branches. The West Virginia Parole Board decides conditional release, and WVDCR Parole Services supervises parolees through the Princeton office. Mercer's jail map is regional rather than county-centered. The main adult jail is Southern Regional Jail and Correctional Facility in Beaver, across the line in Raleigh County. Note: No adult state prison or federal prison was verified inside Mercer County, but an out-of-county institution may hold a person sentenced there.
